Shots fired during brawl in church parking lot

Sep. 19—A Somerville man accused of firing off a 12-gauge shotgun during a brawl in a Lacey Spring’s church parking lot last week has been released from jail, according to Tuesday filings in Morgan County District Court.

David William Vanderpool, 41, is charged with two counts of shooting into an occupied vehicle — a Class B felony — stemming from the Sept. 11 incident, according to the Morgan County Sheriff’s Office (MCSO).

Vanderpool was located two days after the alleged shooting and booked into the Morgan County Jail, according to the Sheriff’s Office. Court records show he was released from jail the same day on a $10,000 bond.

Deputies responded to a shooting call last Wednesday evening at 176 Darden Drive in Lacey’s Spring to find a bloodied man and his fiancée, according to details revealed in MCSO Investigator Erica Delgado’s affidavit, filed Tuesday.

“The male victim advised deputies that the incident was over a male subject … who was caught touching his 13-year-old daughter about two weeks prior,” Delgado said in the affidavit.

The alleged male victim told deputies that, earlier that evening, he spotted the alleged groper while waiting with his fiancée for pizza at a gas station on U.S. 231, according to the affidavit. The victim then approached the man’s vehicle and “threw a punch” before returning home, apparently believing that the man was calling law enforcement.

Later, the victim noticed a Chevrolet Suburban driving slowly past his residence. He told deputies that he recognized the vehicle as belonging to a friend of his — a friend who shares a surname with the alleged groper, according to the affidavit.

The victim told deputies that the Suburban sped off when he stepped out his front door, and he then got into his vehicle with his fiancée and followed it, according to the affidavit. Eventually, both vehicles pulled into the parking lot at Highland Baptist Church, about 2 miles northeast of Union Hill.

The victim told deputies that he immediately began fighting, outside the vehicles, with the person who he thought was his friend, according to the affidavit.

Then, the victim “thought he heard a shot coming from the Suburban, and as he looked up, he could see what appeared to be the barrel of the shotgun,” the affidavit reads.

The alleged groper then exited the Suburban and joined in the fray, according to the affidavit. A third man, identified as Vanderpool, then allegedly exited the Suburban holding a shotgun.

The victim told deputies that Vanderpool approached him during the fight, and he “was hit over the head with the shotgun.”

In a daze after the alleged strike, the victim told deputies that he drove back home, believing he had been shot, and told his fiancée to call 911.

The victim “was transported to Huntsville Hospital and was released a few hours later with minor cuts and bruises but no gunshot wound,” according to the affidavit.

Court records show Vanderpool is accused of shooting into the victim’s vehicle while the victim’s fiancée was inside.

Vanderpool had yet to retain or be appointed an attorney on Wednesday, according to court records, and had not yet been scheduled for his initial appearance in court.
