Aug. 6—GRAND FORKS — A Fort Totten man,
recently apprehended by Grand Forks law enforcement
after a seven-hour standoff, has been charged with three related crimes.
Collin Wade Posey, 32, faces up to five years in prison for the charges, which are all Class C felonies: burglary, preventing arrest and criminal mischief causing damage between $2,000 and $10,000.
At approximately 4:30 p.m. on July 22, an FBI agent urgently requested police assistance at a Grand Forks apartment building associated with friends and family of Posey — a wanted fugitive, according to an affidavit of probable cause filed in the case.
Posey had five outstanding warrants in Grand Forks County, as well as two federal warrants, according to a Grand Forks Police Department press release issued after the incident.
The federal warrants were related to suspected involvement in a criminal conspiracy including fentanyl and methamphetamine distribution, according to the FBI website.
An FBI agent said he observed Posey near the residence. When he attempted to apprehend Posey, he “immediately turned and dove headfirst into the open window,” the statement said.
The area was contained. Law enforcement made numerous announcements over the PA system, including to identify themselves as law enforcement, telling Posey he was under arrest and instructing him to leave the building with his hands in the air.
Posey allegedly failed to exit and surrender himself.
After approximately seven hours — during which light sound diversionary devices, chemical munitions and less lethal impact munitions were deployed — law enforcement decided to enter the unit they suspected Posey was barricaded in.
They found him hiding behind a couch, and brought him into custody without further incident, the statement said.
The unit’s renter said she did not know Posey, had never spoken to him and didn’t give him permission to enter her home.
She told law enforcement she was in the bathroom when she heard men yelling outside. Noticing a door was shut that she recalled being open, she exited the apartment through the window with the FBI agent’s assistance.
She said approximately $100 worth of her items had been destroyed. The owner of the building reported approximately $3,200 of damage to the unit, including broken ceiling tiles and damage to the sub-floor above the tiles.
Posey’s initial appearance was held Monday, Aug. 5. His next appearance, a preliminary hearing and arraignment, is scheduled for 9 a.m. Sept. 16.
