Dec. 28—GRAND FORKS — A Fort Totten man was sentenced to five years Thursday, Dec. 26, for
an attempted escape from custody
after he was arrested in July on multiple local and federal warrants.
Collin Wade Posey, 32, pleaded guilty to Class C felony escape-felony arrest or charge, Class C felony possessing contraband useful for escape and Class A misdemeanor criminal mischief causing willful, reckless damage between $2,000 and $10,000 or intentional damage between $100 and $2,000.

Posey was in police custody on July 28 at Altru Hospital for medical treatment when an anonymous tip came in that he was planning to attempt an escape that evening, according to an affidavit filed in the case.
He was then moved to another room and searched. Items found in his previous room included a butter knife, disconnected hospital phone, pair of socks and empty tape dispenser with a jagged edge. It was later determined that Posey sawed through a handrail he had been handcuffed to, causing more than $1,000 in damage.
Posey was sentenced to five years with the North Dakota Department of Corrections and Rehabilitation, followed by three years of supervised probation. The sentence will be served consecutively with any federal sentence handed down in an ongoing drug trafficking case, but concurrent with multiple state cases recently closed or still pending.
He has no credit for time served.
Posey’s final pending Grand Forks County case,
for an alleged standoff with law enforcement
and the damages that resulted from the incident, is scheduled for a change of plea at 9 a.m. Feb. 3.
