ELKHART — An Elkhart man who is accused of having a firearm on school grounds allegedly told police he was waiting for his niece.
Destry Allen Jr., 25, was charged Monday with possession of a firearm on school property following an encounter with police on Aug. 15. The charge is a Level 6 felony.
According to court documents:
Officers with the Elkhart Police Department responded to Northside Middle School for a report of a suspicious person with a firearm. Police found Allen in the area, who they say was open-carrying a large revolver in a holster on his hip.

Officers removed the firearm from Allen. He told them that he was just walking his niece to school and didn’t know he couldn’t have a firearm on school property, according to police.
A school security officer told police that Allen was on the sidewalk in front of the school earlier in the morning. The guard said he told Allen that he needed to leave the property because of his handgun.
Allen didn’t immediately leave and said he would go once he saw his niece make it into the school, according to police. He left after a repeated warning from the security officer.
