Police release man who admitted to fatal north Phoenix shooting

Police released a man who had admitted to fatally shooting another in north Phoenix as detectives continue to investigate the death.

Sgt. Rob Scherer, a department spokesperson, said officers responded to the area of 18th Avenue and Cholla Street about 11:30 p.m. Wednesday. They found 26-year-old Marcos Antonio Daniel-Elby with at least one gunshot wound.

He was pronounced dead at the scene.

Homicide detectives spoke with a man who admitted to his involvement in the shooting and was ultimately released from custody pending additional information, Scherer said.

“Additional details related to this incident remain part of the ongoing investigation,” Scherer said. “Once complete, this case will be submitted to be Maricopa County Attorney’s Office.”

Scherer did not offer any contextual information about why officers released him, such as whether the man claimed to have acted in self-defense.
