Subject: Urgent Call for Adherence to Judicial Policy in SPL Custom Bail Application 113/24
Karachi, Pakistan [October 5, 2024] – We are deeply concerned about the blatant violation of judicial policy in the SPL Custom Bail Application 113/24. The application, filed on October 2, 2024, before Honorable Justice Aga Faisal Shab, should have been decided within seven days of its submission, as per established judicial guidelines. However, the court has inexplicably fixed the hearing date for October 23, 2024.
This delay not only contravenes the judicial policy but also severely undermines the fundamental rights of the applicant, who is currently incarcerated. The applicant’s right to a speedy trial and the presumption of innocence are being compromised due to this unnecessary delay.
To address this grave injustice, an urgent application was filed requesting the court to expedite the proceedings and adhere to the stipulated timeframe. Unfortunately, this urgent application has also been dismissed, further exacerbating the situation.
We have formally brought this matter to the attention of the Honorable Chief Justice of the Sindh High Court, who has directed the Registrar to take necessary action.
We urge the judiciary to take immediate steps to rectify this situation and ensure that judicial policies are strictly adhered to. The rule of law and the protection of individual rights are paramount principles that must be upheld at all times.
